Unheeding of the nikahnama set by the All-India Muslim Personal Law Board dated May 2005, the Muslim Women board of India has zeroed on writing down their own nikahnama keeping in mind the protection of the Muslim women community. They have decided to release a law in which there will be no gender segregation so as to safeguard the women’s welfare. The law will ensure parallel rights on both the sides: the man as well as the woman.
Shaista Ambar said that the law will be in vogue from the very next month and a body comprising of 30 members is already formed. The earlier nikahnama merely insisted on men to stay away from divorce as far as possible but no mention was made about the ‘halala’ and the ‘triple talaq’. Neither does it ban the non-obervance of Teen Tuher. The present nikahnams will maintain a strict decorum on all this persisting issues.
The law will further make it almost mandatory that the payment of meher is to be made either before or during the nikah. This is certainly going to change the traumatic life led by the Muslim women.
